The upcoming end of the Public Health Emergency (PHE) will change the way telemedicine works. We’ve been preparing for this moment and have plans in place to continue providing the care you need.

PHE updates

On February 24, 2023, the Drug Enforcement Administration (DEA) released its proposed rules for telemedicine and controlled medications.

Existing patient on controlled substance
If you are a current telemedicine patient prescribed a controlled substance prior to May 10, 2023, the DEA requires you to have a qualified referral on file no later than Nov 7, 2023, in order to continue treatment.

New patient after May 10, 2023
For a new patient after May 10, 2023, who wants telemedicine service to treat their ADHD, the DEA requires you to have a qualified referral on file before initiating treatment. This requirement also applies to a current telemedicine patient who is considering initiating new treatment with controlled substances.

If your medication is not on the list of controlled substances, ADHD Online can continue prescribing it for you without the form from your doctor.

We understand that finding a doctor can be difficult. For current patients, as the regulations stand, we will not be able to continue prescribing certain medications after November 7, 2023, without a qualified referral on file. Look for a Primary Care, General Practitioner, pediatrician, or internist near you (if you have insurance, be sure they are in-network) to set up an appointment.

During the COVID pandemic, the federal government implemented a Public Health Emergency. This allowed the fast-tracking of vaccine development, paved the way for certain immuno-therapies, and made space for other important public health allowances. It also permitted telemedicine companies to prescribe all medication, as telehealth became the primary form of care for many people.

On January 30, 2023, President Biden ordered that the Public Health Emergency be lifted as of May 11, 2023.

Current patients receiving care via telehealth and prescribed a controlled substance will need a qualifying telemedicine referral by a practitioner who has performed an in-person examination.

Your doctor can also provide a direct referral to us.

You must have the form on file with us by November 7, 2023.

Long story short

Before the pandemic
In 2008, the Ryan Haight Act went into effect, stating that, with limited exceptions, a clinician must conduct an in-person medical examination of a patient in order to prescribe a controlled substance. Named after Ryan Haight, an 18-year-old who died of an overdose after he had Vicodin delivered to his home by an online pharmacy, the act is intended to regulate how doctors, retailers, and pharmacies prescribe controlled substances.

During the pandemic
During the COVID pandemic, the federal government implemented the PHE. This removed barriers for important healthcare activities and allowed fast-tracking vaccine development and approval of immuno-therapies. It also permitted telemedicine companies to prescribe all types of medication without an in-person exam, an important allowance since telehealth became the primary form of care for many people. The PHE has been extended continually since 2020.

After the pandemic
As of May 11, pre-pandemic rules will be back in place and telemedicine companies will not be able to prescribe controlled substances without an in-person appointment on file. This would include many medications typically prescribed to individuals diagnosed with ADHD and other mental health disorders.

The patient completes our asynchronous assessment and receives the report from a doctorate-level psychologist within 3-5 days.

The patient schedules an initial appointment with one of our providers to develop a treatment plan through a secure virtual appointment.

The patient schedules subsequent follow-up visits with our providers for ADHD medical treatment or behavioral therapy.
